Nintendo Sues Over Premature Switch 2 'Mockup' Reveal
Nintendo has initiated legal action against the accessory manufacturer Genki, alleging trademark infringement after Genki showcased renders of a purported "Nintendo Switch 2" mockup well before Nintendo officially unveiled its new console. This legal battle stems from events at CES 2025 in January, where Genki displayed their Switch 2 mockup, claiming it was based on an actual Switch 2 system they had access to for developing their accessories.
According to court documents reviewed by IGN, Nintendo accuses Genki of launching a "strategic campaign" to exploit public interest in the upcoming console. The lawsuit lists charges of trademark infringement, unfair competition, and false advertising. Nintendo claims Genki boasted about having early access to the unreleased console and allowed attendees to interact with the mockups, misleading the public about the compatibility of Genki's accessories with the Nintendo Switch 2.
The court papers detail that in January 2025, Genki began advertising unauthorized access to the Nintendo Switch 2, even though the console had not been publicly revealed by Nintendo at that point. Genki's statements were later contradicted, with the company admitting they never possessed a console, yet continued to assure consumers of their accessories' compatibility with the upcoming console.

Nintendo further alleges that Genki infringed on its trademarks through its marketing efforts and directly competed with Nintendo and its authorized accessory licensees. A tweet from Genki's CEO, Edward Tsai, and a pop-up on their website, hinting at secret access to Nintendo's headquarters, also drew Nintendo's ire.
Nintendo is seeking an injunction to prevent Genki from using the "Nintendo Switch" trademark in their marketing, the destruction of any products or marketing materials referencing Nintendo's branding, and unspecified damages, which they request to be tripled.
In response, Genki issued a statement on social media acknowledging the lawsuit and their commitment to working with legal counsel. They emphasized their independence and dedication to creating innovative gaming accessories, reaffirming their pride in their work and product quality. While unable to provide detailed comments, Genki assured continued preparations for fulfilling orders and upcoming product showcases at PAX East.
The Nintendo Switch 2 is scheduled to launch on June 5, with pre-orders beginning on April 24 at a price of $449.99. High demand has led Nintendo to warn U.S. customers that release date delivery is not guaranteed for those who pre-ordered through the My Nintendo Store.
